FOR IMMEDIATE RELEASE

WASHINGTON, Nov. 9, 2009 - When parties enter into a construction or design contract, a number of implied obligations arise within that contract, whether by law or in equity. These obligations, in force unless expressly altered or excluded by a contract provision, require careful consideration by the owner, designer and contractor. A new webinar, "Implied Obligations in Design and Construction Contracts," presented by WPL Publishing (www.wpl.net) in partnership with Allen Matkins on Tuesday, Nov. 17, will address these obligations and what they mean to each party. To register, visit http://tinyurl.com/contractobligations.

During this 90-minute presentation, construction attorneys Mike Cathcart and Bryan Jackson will discuss:

  • Implied Warranty of Plans and Specifications
  • Duty of Good Faith and Fair Dealing
  • Duty to Share Material Information
  • Duty to Provide Access/Duty to Coordinate/Duty to Not Interfere
  • Implied Warranty of Fitness for a Particular Purpose or "Habitability"
  • Implied Warranty of Workmanship
  • UCC Implied Warranty of Merchantability
  • UCC Implied Warranty of Fitness for a Particular Purpose

Robert "Mike" Cathcart is a partner in the Los Angeles office of Allen Matkins Leck Gamble Mallory & Natsis LLP. He has spent more than 28 years of his career as a construction litigation attorney with emphasis in construction and real estate disputes. Cathcart is also well versed in handling alternative dispute resolution proceedings.

Bryan Jackson is also a partner at Allen Matkins and is an expert in drafting and negotiating construction and design contracts for all types of projects. He chairs the firm's construction transaction group. Jackson is also an adjunct professor at the University of Southern California, teaching graduate-level courses in construction law, technology and management.

This webinar is a must for construction professionals, engineers, architects, owners, contractors, subcontractors, manufacturers, suppliers and the attorneys who represent them.
