Good day Planners,

Just like to ask.. Can a client penalize a contract with LD (liquidated damages) without giving an extension of time. The subject came about on a bidding we just participated in The project is a Super Store Big retail outlet.

Can you shed light on this?

Thanks

Yes, the Employer can apply LD’s without giving Exetension of Time under the Contract.

It depends really on the provisions (the whole mechanism of claim and LD) of the Contract.
Has the Contractor complied with the requirements of the Contract (such as notices, and submission and justification of the EOT cliam itself)? It is then the ER’s duty to reply. Also, for the ER to impose LD, he needs to issue CNC.

Then all claims will be on cost or say all time related claims will be classified as prolongation and/or acceleration
