Hi Friends,

A Query,
A claim is submitted for a work for an activity which is outside the BOQ and unquoted price. Work is completed upon the instruction by the engineer without the claim being finalised and the claim is not cleared by Engineer / Employer within 84 days of submission of the claim. After 84 days there is a drastic increase in the cost of the unit rate of activity. Do i have the right to revise my claims based on current unit rate?

Regards

Irfan

    Irfan,

It is a question with several possible answers but as long as an agreement hasn’t been reached, then in general yes.

What you are actually entitled to claim however is another matter all together but until agreement is reached you are in general, free to reach what ever agreement you see fit too.

At the end your response will be that

"Friends what you said, all were thrown out of window."

So better to judge your claim under contractual provision as well as by conduct of Parties
