It is very common now in UK since the introduction of the HG&RA that main contractor issue a schedule of application.
This is just a list of dates which application from a s/c should be submitted so the application can be incorporated into the main contract valuation.
Sometimes this schedule of application also tie in with the payment schedule.
I have noticed some clever QSs or team have set it up in such a way that the MC kept their cash longer and so the S/C will not receive the monies certified by the PQS until much later eventhough thiss suppose to be a back to back contract. Although I noticed this but due to the lack of knowledge on the legal position, I am not sure whether it can be challenged.
Can anyone explain what is the legal position for the S/C in cases like this and whether anyone else have had any experience on this issue.
Thanks
