Dear All,
Would you please share understanding about the following case?
I involved in the Project consist of the Process Area and Off Site Area.
There is case as follows:
- Potential Delay on Process Area due to Contractor fault.
- Potential Delay on Off Site Area due to Owner fault.
The facility that potentially delay on Off Site will not affect to entire process of the plant. This is only perimeter fencing.
The Subject Penalty stipulated in the COntract is Final Mechanical Completion for entire Facility (Process and Off Site Area).
My question is : May Contractor get Extention of Time for Process Area (in addition to Off Site Area)? and then the Penalty date is based on the new agreed date for the Extention Time for Off Site Area (Perimeter Fencing)?
Thanks
Tandyo
