It has been observed that some Subcontractors (not nominated in the Contract) usually directly approach to the Client for their payments due by the Contractor during execution or most probably at the end of Project which is totally incorrect and non contractual. Despite the Client refused to settle this issue and re-refer the matter to the Contractor as its own dispute, the Client unilaterally deducted these amounts from Contractor’s Account.
My question is that:
How can a Contractor defend this issue contractually so that Subcontract could not directly approach to Client and also the Client may not withhold any such disputed amounts?
